TERMS AND CONDITIONS

These Terms and Conditions for using the online store www.hertz.md apply to orders for the purchase of products/services offered by Pascal Travel SRL through the website.
For proper use of the site, we recommend that you carefully review the presented Terms and Conditions. We reserve the right to make changes to these provisions without prior notice.


1. GENERAL PROVISIONS

This website is owned by Pascal Travel SRL. By placing an order in the online store, the Buyer accepts the Terms and Conditions of sale of goods/products and/or provision of services based on the legislation of the Republic of Moldova (hereinafter – Terms and Conditions) presented below.

Using the website implies acceptance of the Terms and Conditions proposed by Pascal Travel SRL, in accordance with Law No. 284/2004 on Electronic Commerce. The relationship between the client and the seller is established based on Law No. 105/2003 on Consumer Protection, as well as other normative acts adopted in accordance with it.

The Seller reserves the right to modify these Terms and Conditions, and the Buyer is responsible for monitoring any changes.

Car - means the passenger vehicle described in the Rental Agreement with its technical details in the Check-in/check-out Protocol (Annex 3).

The term "Car" includes all additional equipment, accessories, tools, documents and spare wheel (if provided), as well as the replacement vehicle.

RENTER, DRIVER, ADDITIONAL DRIVER.

Renter - means the signatory of the Rental agreement, which has full capacity and can assume the obligations mentioned in the present agreement. If there is more than one renter, all the renters shall be severally liable toward the lessor. In case Renter and the Driver are two different persons or if Renter appoints additional Drivers or authorized persons. The Renter is responsible for all the breaches of the present agreement by the Driver of additional Driver. The Driver, respectively the additional Driver undertakes to respect all contractual obligations that Renter has assumed.

Driver - is the person whose name is mentioned in the Rental agreement as driver. Only the Driver can drive the car, unless we allow an additional Driver.

The Lessor can approve additional driver(s) that the Renter requires for a fee to be added in agreement, with the contractual obligations and same responsibilities for the car as the Renter.

Additional Driver is the person whose name is mentioned in the Rental agreement as a driver. Besides Renter and the Driver, only the additional Driver can drive the car.

Age restrictions. For drivers under 25 and over 70 years of age, an additional charge is made and/or the duration of possession of a Driver’s License may apply to certain car groups.

BOOKINGS, CANCELLATIONS, OFFERS

Bookings can be made by phone, e-mail or online on the lessor’s official website or partners websites, through smart phone application, or in writing by letter to the address of the Lessor’s locations.

Reservation. Reservations refer to categories of cars. Bookings for a car in a certain category do not imply entitlement to allocation of a particular model within such category. The offer is based on the Rental information and these Terms and Conditions; both are also available on the official website. The Lessor issues a written (by e-mail) or verbal offer. The offer remains irrevocable for a period of 1 day, except in the event of insufficient availability of cars.

Cancellation. Cancellations are required to be made at least 24 hours prior to the start of the rental. Cancellations submitted outside office hours are deemed to have been received the next calendar day. Cancellations outside office hours can only be made in writing by letter to the address of the main office, by phone, e-mail, or official web-site.

Prepaid Rates. Amendments to bookings may be made prior to commencement of the rental and with 24 hours’ advance notice, with the renter being charged the corresponding amount at the amendment rate established in the reservation. The price applicable following the amendment of the booking shall be that resulting from the application of the rate in force at the time the amendment is made.

A booking can be cancelled before the start of the rental. If a booking is cancelled, the following cancellation fees are payable by the renter:

-In the event of cancellation, the charge shall be the amount of the rental charge (including any extras and charges) for a maximum of 3 rental days.

- In the event of cancellation on the first day of the rental period or later, the cancellation fee is subject to the maximum of the rental price or the balance thereof.

- In the event of a prepaid booking cancelled on the first day of the rental period or later, the No Show fee is subject to the maximum of the rental price.

- Cancellations submitted outside office hours are deemed to have been received the next calendar day.

The Lessor does not make a refund of sum paid when making a booking in any of the following circumstances:

- If the renter did not use some of rental days;

- If the renter did not show up to a car rental counter on the pick-up day, or showed up late, or dropped the car off ahead of schedule.

- If the renter is unable to pick up the car for the reason that some of his documents (driving license, car rental voucher, passport or other ID) do not meet the Lessor Terms and Conditions.

- If the renter is unable to provide credit card in driver’s name, or there are not enough funds on it to block a security deposit.

- If the renter was previously blocklisted by the car rental Renter.

RENTAL AGREEMENT

The agreement is concluded through acceptance of the offer or based on the reservation in accordance with point 4. A verbal agreement is confirmed by the Lessor by signing the agreement.

The Lessor is entered into for the period and rate stated on the rental agreement. The rental agreement further states the details of:

- Type, model, the registration number of the rented car;

- the start and end date of the rental period;

- the rental price and any additional cost components, such as price per kilometer.

The rental rate is calculated on the basis of the standard daily rate depending on the class of Car, number of days of rent, available discounts, and insurances and other protection charges included in rental rate.

- additional services such as additional divers, insurance packages, child seat, Navigaton, WiFi-Rooter or others additional services the Renter may have order.

The total rate is stated in the corresponding section of the Rental Agreement and is paid by the Renter upon the delivery of the Car to the rent.

Car rentals are on a daily basis. In case of late returns (over 24-hour) the Renter will be invoiced additionally for 1 full-day with all extras (if it has announced in advance the extension), if not have any information about late return of the vehicle, the measures provided for in point 13 shall apply.

Upon returning of the Car, the additional payment due to the extra mileage or for extra-time of rent, basis on the rates stated on official website of at the Lessor’s office, and, in case of damages will be additionally charged with damage charges according to the Damage charges list (Annex 2).

During the rental period, costs in relation to the use of the car, such as toll, fuel, cleaning and parking are at the expense of the renter,

Except the cost of 1 tank of fuel if the Prepaid Fuel option is purchased by the Renter.

Documents which the renter must present for the agreement before picking up car:

  • Personal identification card, and travel passport for persons required a visa.

  • Driver's license necessary for driving the car and valid in the home country, also for additional driver if applicable;

  • Debit or Credit card as valid means of payment.

In the case of business rentals, they must state their registration number and /or V.A.T. number.

RENT

Payment for the rental shall be effected upon signing of the Agreement before delivery of the car in rental:

- day rental charge, variable according to the official website at the moment of signing the agreement or according to the reservation made by the Renter before the rental. The charge can include price for protection packages (Inclusive rate) and limited or unlimited mileage.

- Protection packages, additional rent rates: CDW, TOP COVER CDW, SUPER TOP COVER CDW, TP, TG;

- Age excess;

- Aditional driver ;

- Personal insurance;

- Road Assistance;

- Location of auxiliary accessories: GPS navigator, WiFi rooter, Telephone, Child/Baby seat;

- Prepaid Fuel;

- Foreign use;

- Delivery/Collection service;

- Driver Service;

- Airport fee;

- VIP lounge;

- Priority parking;

- Out of hours fee;

- Other additional services.

The lessor accepts the rental payment with credit cards issued from Eurocard/Mastercard, Visa and American Express. The lessor accepts prepaid cards or debit cards (VISA Electron/Maestro).

Cash Payment is accepted for rentals in combination with a valid Credit Card.

The renter will pay to Lessor for additional invoice issued within Rental agreement in accordance with Annex 2 if the car has not return in proper working order, correctly-maintained, and with damage to the bodywork, as it was received at the time of the rental, as well as charges beyond control of the Lessor that produced throughout the rental due to the fault of the Renter.

All rental rates for vehicles are expressed in MDL (Moldovan lei) and include VAT, in accordance with the legislation of the Republic of Moldova. Payment must be made in full in MDL prior to the vehicle pick-up. Any additional costs, including applicable fees or extra services, are also expressed in MDL and included VAT.

SECURITY DEPOSIT

Prior to the start of the rental, before the delivery of the Car to the Rente, the lessor shall request from the Renter to provide a guarantee deposit securing payment obligations or liabilities to be assumed by the renter. The deposit ‘s amount depends on the car/category and protection package.

The deposit is to be placed by the renter using a credit card which is accepted by the lessor or in cash only in combination with a valid Credit/Debit Card. 4.3 The time left until the credit card used to place the deposit expires must exceed minimum 3 months the term of the Rental Agreement. The Lessor shall request an pre-authorization from the Bank which issued the credit card for the amount of the deposit. For the L***, P*** car groups two credit cards can be requested.

If at the time of concluding of the Rental Agreement, the Renter cannot provide the deposit, the Lessor may refuse to deliver the Car to the renter.

This deposit obligation shall also be applicable in respect of prepaid rentals (paid by Renter on the renter website), the renter undertaking to present the credit card with which the Renter made the booking.

The deposit blocked on Renter’s card or paid shall remain up to 30 days in the lessor’s possession to secure all payment obligations assumed by the renter based on Rental Agreement.

Once the Renter returned the car in accordance with rental Agreement the amount of deposit will be fully released/paid if bellow conditions are met:

- Lessor and Renter made necessary inspections of the returned car and the both parties sigined the Check-in Protocol (Annex 3),

- Renter previously paid the amount billed to the renter for the rental,

- Renter paid the additional amount invoiced exiding the amount initially agreed in the rental agreement, as a result of damages, extentions, cleaning, fueling and other fees.

- the Lessor will close the Agreement as a result of above conditions.

In case of the return the Car does not meet the requirements of Rental Areement, in case of damages, losses, extention of rental and others, the additional Invoice will be issued, and even-thougt the Renter refuses to sign of the Check-in Protocol or/and accept the charges, the Lessor have right to retain a part or whole deposit in order to cover all amounts acording to the prices mentioned in Damage charges list (Annex 2).

The lessor is entitled to use the credit card wich was used for deposit, without limitation to request any amounts payable over and above the amount of the deposit placed upon the signing the Agreement for damages, fueling, losses of documents, penalties, objects etc.

Due to fluctuating foreign exchange rates and other possible banking charges, the Lessor cannot be held responsible for any difference between the amount paid and the amount refunded.

CHECKOUT OF THE CAR

The Lessor will hand over the Car to the Renter in working condition and for the purpose that it was built: in good exterior, interior and technical conditions, fully equipped, clean, supplied with a full tank of fuel. At delivery the Lessor and the Renter shall perform an extensive check of the condition of the rented Car and to approve it by signing the Check-out Protocol (Annex 3). Any objection with respect to the condition of the Car notified by the Renter on delivery of the Car will be mentioned by the Lessor in Check-out protocol.

Together with the car the Lessor will hand over to the Renter the ignition key is and necessary documents according to legislation:

- Registration certificate,

- Third party insurance and

- Technical inspection report.

In case the Car will not be operational, for other reasons than the Renter’s own fault, the Lessor will replace it, upon request. The replacement Car will be, if possible, similar to the initial one, in 24 hours, according to the traffic conditions. In case the Lessor will not be able to replace the Car in due time, Lessor will reimburse the afferent rental cost proportional to the duration in which the Car was unusable.

ADDITIONAL SERVICES. EXTRAS

Additional Driver. A charge is levied for the additional driver, whose details are noted in the lease only if the additional driver presents a valid driver's license.

Age restrictions. Certain regulations apply related to minimum age and possession of driver's license which can be found during the booking process depending on the booked vehicle. Basically, the minimum age for every driver in Moldova is 21 years (having held the driving license for at least 1 year). A deviation from the minimum age is possible depending on the vehicle. In Moldova, the following rules apply for the minimum age and possession of a driver's license:

  • 21 year, License held for 1 year for M***, E***, C***, I*** ;

  • 23 year, License held for 3 years for S***, F***, L***, P***, X*** ;

An additional fee will be charged for drivers under 25 and over 70 years.

Personal Protection (PAP). By taking out personal accident protection can also be extended to cover the consequences of an accident.

By taking out PAP the limit of liability is:

- 200,000.00 MDL (~ 10,000.00 EUR) for invalidity of the driver,

- 50,000.00 MDL (~ 2,500.00 EUR) for decease of the driver.

No cover for medical costs.

Roadside protection. The Lessor can provide the renter a fast roadside assistance within 8 hours from the moment of receiving a notification or replacement car. All services may only be ordered by a direct claim with 24-hour Roadside Assistance (phone +373 79 99 19 19). They shall also determine the type and extent of service required to ensure the renter stays mobile. If any damage to the rental car occurs which is not covered by the Lessor within the scope of the Roadside Protection, the renter is liable for such damage.

Roadside Protection package is your extended breakdown protection during your rental and protects you against high service and repair costs for the following incidents caused by you:

1) Key locked in car: In the event of the key being locked inside the car, Lessor shall assume the costs for the car to be opened by the car manufacturer or one of its partners, for the car to be towed away and for a replacement car.
2) Breaking caused by lack of fuel: In the event of a breakdown due to having run out of fuel, Lessor shall assume the costs for breakdown assistance and fuel required for the onward journey.
3) Assistance with starting necessitated by flat battery: In in the event of assistance with starting being needed, Lessor shall assume the costs for assistance by the car manufacturer or one of its partners.

4) Loss of key: In the event of a lost key, Lessor shall assume the costs for providing a spare key, the transport/shipping of the spare key, for the car to be towed away and for a replacement car.

5) car stuck: In the event that it is not possible to move the car (eg due to winter road conditions) Lessor shall assume the costs for the car to be towed away and for a replacement car.
Exclusions: Cost of fuel, battery, keys and tires themselves are not included. Roadside protection and assistance conditions are not valid and applicable outside Moldovan borders.

6) In case Roadside protection is not accepted Lessor will provide to the Renter roadside assistance within 24 hours and following administrative expenses for providing road assistance will apply.

Location of auxiliary accessories: GPS navigator, WiFi rooter, Telephone, Child/Baby seat. Accessories are bookable without obligation and subject to availability and are a subject to a fee.

Prepaid Fuel. The Renter may purchase a tank full of fuel at the time of rental at a price that is competitive with local fuel stations and return the tank empty (Prepaid Fuel). No refunds will be given for unused fuel.

Foreign use. For travels abroad, additional charges may apply and are governed by the respective country of entry and must be requested at the local rental station.

One-Way Rentals. All One-Way Rentals are on request.

One-way rentals within Lessor locations in Moldova and All International One-Way Rentals are allowed under conditions depending on tariff.

All International One-Way Rentals are on request.

In the case of unannounced and unauthorized one-way rentals, we reserve the right to charge an additional fee.

Delivery/Collection. The Renter will be asked to additional charge for each delivery/Collection not at the lessor’s Location at working hours accordingly within city limits or outside city limits. The Renter will be asked to additional charge for each pick-up of the Car, according the Agreement not at the lessor’s Location at the parking area initially stipulated. Dellivery/Collection in out of opening hours is possible only on request, within city limits or outside of city limits.

Driver Service. By choosing the driver service, a driver will be supplied for 9 consecutive hours per day during business hours. Additional hours and services outside business hours are available at the local branch. The customer remains liable for the condition of the vehicle except when the vehicle is physically moved by the Lessor driver.

In the event that Personal Accident Protection (PAP) is not included in the price, it is mandatory to book it.

Driver services are available within respective city limits and any trip outside the city limits will need to be coordinated with the Lessor location in advance. Additional charges for leaving the citylimits may arise and will be charged extra locally. Please contact the local branch for more information.

Airport fee - a fee levied for the benefit of the airport managing body and paid by airport users and / or air passengers for the use of facilities and services provided exclusively by the airport managing body and relating to landing, take-off, lighting and parking of aircraft, passenger management and handling of goods.

Chisinau Airport charges the following fees: security fees, international passenger service fees, sales fees, modernization fees.

VIP Lounge Services. For maximum comfort and time saving, you can use the services provided by qualified personnel of the VIP Lounge of the Chisinau International Airport.

On arrival: meeting at the ladder of the aircraft by an employee of the VIP Lounge, transportation to the VIP Lounge on a special minibus, delivery of baggage, assistance in luggage carriage, free Wi-Fi. The Renter’s cars will be delivered at a special parking lot, within VIP Lounge terminal.

On departure: quick performance of the necessary formalities, assistance in luggage carriage, ticket and luggage registration, snack bar (free snacks and beverages), computer, free Wi-Fi, fax, scanner, telephone, Xerox, printer, periodicals, acRentering and transportation to the aircraft in a minibus.

Children from 2 to 12 years are served with a discount of 50% of the price, children up to 2 years – free of charge.

Priority Parking Service. The Priority Parking Service can be booked at the airport for a fee. The vehicle is handed over directly at the terminal.

Out of Opening Hours Delivery/Collection is available at selected stations. In this case, an additional charge applies for the provision of the service.

Winter equipment. Winter tires and snow chains are available subject to a fee.

During the period of November 1st until March 31 winter tires are mandatory if the roads are covered by snow, ice or glazed frost and will be charged.

INSSURANCE AND PROTECTION PACKAGES

The responsibility for the damages can be limited to non-variable responsibility (CDW) chosen by Customer by signing the Agreement, with the condition of present T&C (p. Exclusions and Accident):

- Collision Damage Waiver (CDW) reduces the drivers' responsibility to a part of the car in case of damage. If CDW is not accepted according to Exclusions the customer will be held liable for the full value of the car. If CDW is already included in the rates, the customer can choose Super Cover CDW to reduce the Non-Waiverable Responsibility.

- Theft Protection removes the driver's responsibility to a part of the car in case of theft.

- Glass and Tires removes the driver's responsibility to damages of the wheels and glass.

Insurance packages not provide protection for areas considered as a risk territory (Transnistria region and Crimea) and does not apply for damages that occurred outside Moldova.

EXCLUSIONS

Generally, in case of gross negligence or intentional actions or one of the mentioned bellow will exclude any insurance or protection packages, and the renter will be responsible for any damages, thefts or total loss and all the inssurances and protections packages are not valid. Renter is strictly forbidden:

to park the Car in unsurveid locations;

to leave the car unlocked anytime the driver leaves it;

to leave in the Car their documents while the Car is unattended;

to leave the car with the engine started and/or with the key in ignition;

to Use/drive the car under influence of alcohol, narcotics, hallucinogenic medicines or other substances that impair their awareness and responsiveness that could affect the Renter’s driving abilities;

to drive the car for illegal purposes, in violation of the applicable provisions of law, e.g. customs, traffic or other;

to drive the car by other persons than the ones authorized by Lessor, mentioned in Rental Agreement as Driver and/or Additional driver.

to use the car for transportation of persons or goods.

to overload the car and will not allow to transport more passengers than the number of passengers it was designed or equipped;

not transport dangerous or inflammable substances.

will not use the car in racing, training or competitions

will not use the car for towing other cars, trailers or other objects, thrust, learning drivers or other risky or unusual uses.

will not subsequently sub-rent; sell, lease or dispose of the car in any way, the Renter will not present himself as the right owner of the car or as Lessor representative.

will not remove or move any of the identification signs and marks of the car or of the ownership of the car.

will not perform or allow the performance of actions on the car without our consent, except for minor, urgent repairs, that must be executed by a qualified mechanic.

To drive the car off-road or on unpaved surfaces, in geographical areas affected by natural disaster.

Journeys outside the territory of the Moldova are forbidden. A written permission issued by the Lessor is mandatory to cross the border.

Cross-border rental is authorised in the following countries: Bulgaria, Hungary, Greece, Austria, Germany, Switzerland, Czech Republic, Montenegro, Croatia, Poland, Slovenia, Slovacia, Romania, Ukraine, (region of) Transnistria.

Insurance packages not provide protection for areas considered as a risk territory (Transnistria region and temporarily occupied territories of Ukraine).

All Cross Border Rentals are on request, including to Transnistria.

For travels abroad, additional charges may apply and are governed by the respective country of entry and must be requested at the local rental station.

Entry to the Autonomous Republic of Crimea, Donetsk, Kherson, Luhansk, Zaporizhzhia region is prohibited.

Cross Border Rentals are not allowed for car groups P***, L*** and X***.

In case of offence against Cross Border & Territorial Restrictions all protections lose their validity.

Ferrying the car is not allowed. In case of offence against all protections lose their validity.

Foreign Use Charge
For travels abroad, additional charges may apply (250 EUR) and are governed by the respective country of entry and must be requested at the local rental station.

LIABILITY OF THE RENTER

The renter is liable toward the lessor for any damage caused to the car during the term of the rental, for the total or partial theft of the car and any damages deriving from breaches of Agreement, except as established in the limitations on liability and optional coverages contracted (see clause of Article 12) and as may result from the application - for aspects not regulated by these conditions - of currently applicable legal provisions. If the limitations on liability envisaged in clause Article 12 are contracted and a loss event occurs, the renter shall only be liable toward the lessor as indicated below, in addition to the corresponding amount reflected in the Damage charges list (Annex 2).

a) for damages which the renter or persons for whom the renter is answerable, have caused through acts of wilful misconduct or gross negligence;

b) when the renter fails to hand over the report describing the accident report, or does so late or incompletely, or includes in such reports false statements and information;

c) for damages caused to the lessor in cases in which there was a duty-of-care default or default on the obligation to request the presence of the police, as envisaged in clause of Article 14 , unless such damages were caused without there having been any willful misconduct or gross negligence on the part of the renter;

d) in the event that the damage was caused by an unauthorized driver;

e) In the event of any breach of the bans established in points of Article 3 of these conditions.

Charges for repairs and accessories for which the renter is liable shall be calculated by the Renter selected by the lessor for this purpose, or by official expert. The amount thus calculated – where appropriate, the amount of the excess – shall be claimed from the renter along with the administrative charges for damage processing tasks. The indemnity payable by the renter if the car is a total loss shall be the financial value of the car at the time of the loss event. Charges for the contracting of additional features or additional complementary services subsequent to formalization of the Rental Agreement and during its term. These amounts are to be billed at the charge rates in force at the time of contracting the additional items, as indicated in the Damage charges list (Annex 2), and must be reflected in the new Rental Agreement signed by the renter.

Excess miles. The number of kilometers travelled by the rented car in excess of the mileage specified in the Rental Agreement. The amount charged in this respect shall be billed at the corresponding price for car category. The number of kilometers driven is calculated on the basis of the odometer readings.

Losses. Expenses incurred in obtaining a duplicate of, and/or dispatching the key to the rented car, in the event of such key being lost and/or damaged, and in moving a car immobilized in such circumstances to the lessor’s nearest rental office. Similarly, the lessor shall be entitled to charge the renter compensation for the immobilization of the car. Such compensation charges shall be based on the corresponding price as reflected in the Damage charges list (Annex 2 ).

  • Replacement expenses, in the event that any accessories to the car – such as emergency triangle, the reflective jacket and the first aid kit – are found to be missing. These expenses are to be billed based on the corresponding price reflected in the Damage charges list (Annex 2).

  • Expenses for the replacement of the documentation corresponding to the car in the event that this is found to be missing. These expenses are to be billed based on the corresponding price reflected in the Damage charges list (Annex 2).

  • In the case of rentals for periods in excess of 28 days, the amount of the penalty for failure to return the car on the date indicated in the Rental Agreement or for exceeding by more 100 kilometers the maximum kilometer indicated in the Rental Agreement. This amount is to be billed based on the corresponding car and the corresponding price as reflected in the Damage charges list (Annex 2).

  • The amount for the replacement and placing of the lessor’s advertising signage on passenger cars and cargo cars when such signage has been damaged or gone missing during the term of the rental. This charge is to be billed based on the corresponding price as reflected in the List of Fees and Damage Charges (Annex 2. Damages charges)

  • Unless a written agreement has been reached which indicates otherwise, the charge – based on the prices established in the Damage charges list (Annex 2) for the cost of returning to their place of origin cars which are returned at a center other than that from which they were obtained.

Cross the border. The Renter shall not cross the border of Moldova and shall not enter the occupied territories on the Lessor’s Car without prior permission of the Lessor.

In case of offence against Cross Border & Territorial Restrictions all protections lose their validity and additional fees will be charged with a fine in amount mentioned in Annex 2 and also all other losses and charges bound by such failure to return. In such case Lessor has a right to take all measure in relation to the search of the Car, independently take away it (to get from a rental) and does not carry responsibility for the things of the Renter, which were in the Car.

Refueling Charge. Wrong fuel charge. The customer must provide last fuel receipt, despite the indication of the full tank of ondometer. Otherwise, Lessor will return/unblock the deposit to the Renter in 30 days. The Lessor will charge the Renter with a fee of 1,00 EUR per liter for completing the difference up to the quantity existing at the beginning of the lease period, and addition 5 EUR for refueling fee. Exception: If customer purchased Prepaid Fuel (PF) option at the time of rental: tankful of fuel at the time of rental at a price that is competitive with local fuel stations. No refunds will be given to Customer for unused fuel.

In case the Renter using the wrong fuel type when filling the car, a minimum charge of 300,00 EUR applies together with charges for moving the car and/or the repair of damages caused to it through use of the wrong fuel following an incorrect refueling operation.

Cleaning fee. Special cleaning. The renter has been informed that at return of the car the Renter must bring the Car in clean/acceptable condition for inspection, otherwise a 15 EUR logistics fee will apply. All Lessor’s cars are non-smoking cars. In case the car requires a special cleaning procedure (i.e. smell removal caused by smoking, animal pollution, spill of liquids etc.) after returning, a fine of 100 EUR will apply.

Unauthorized driver. The Renter will be charged with min 100 EUR/day for entire rental period, fee for usage of the car by unauthorized driver.

RETURNING THE CAR

After the completion of the rental the Renter must return the Car at the location and on the date set in the Rental Agreement, as well as sufficiently clean so as it is possible to verify on the spot its actual condition. Otherwise, the Lessor shall reserve the right to first wash the car before checking it, and the Renter has to wait sufficient time (min 1 hour) until the car will be cleaned by the leassor.

The Renter is required to return the Car with a full tank of fuel, with the keys issued with it, documents and other equipment in non-deteriorated condition, exclusively and directly to the Lessor representative. In case the documents and keys are not returned for any reason, the Renter will pay fine in the according to the Damage charges list (Annex 2).

The Renter shall be required to verify with due diligence, together with an Lessor representative the condition of the Car upon its return and all accessories and all the goods provided with the car and to fill-in the Check-in protocol and sign it.

The Renter’s obligations related to the Car continue to apply and remain in full force and effect until the Renter handover the Car to responsible from Lessor to receive the car, confirming by signing the Check-in protocol

The car will be returned at the date and location specified in the Rental Agreement usually during working hours. If the Renter chooses to return the car outside the working hours the Renter will pay the additional costs in this respect.

(Out of hours) In case the Renter wishes to continue to keep the car after the expiration of the initial rental duration, the Renter must follow the instructions provided in point 5.

In case the car is not returned at the date and location mentioned in the Agreement, if the delivery does not happen in three hours from the time mentioned on the back, at the expiration of the three hour term, Renter reserve the right to inform the police that the car is in the Renter possession without our approval and initiate any legal procedures to recover the car. This does not exclude our right to take actions for the direct recovery of the car, on Renter’s expense, resorting to the provisions of the legislation in force.

In the case the Car has been abandoned by the Renter, i.e. its return in violation of the provisions set out in chapter EXCLUSIONS hereof, the Renter shall be fully liable for any damage caused to the car arisen for that reason until the Lessor has learned that the Car was abandoned, its location and it is possible to collect it taking into consideration the working hours applicable to the nearest Lessor’s branch (branch working hours are available on the website.The Lessor’ s representative will verify the car and will mention its condition in the Check-in protocol and will send to the Renter by post or email.

The Rental Agreement shall be terminated as soon as the Lessor receives the Check-in protocol sign by the Renter. In case the Renter refuses to sign the Check-in protocol the Car will be considered rented and the rental agreement will remain open and the rental period will be extended until the Check-in protocol will be signed

In case the Renter refuses to accept the damage charges stated in the Check-in protocol and requires confirmations of the Damage charges on the corresponding order on reparation works, the Lessor will send a confirmation form authorized body-shop / or car dealer with additional costs according to Annex 2), and the rental period will be extended until the renter will not confirm them by signing the Check-in protocol.

The Renter will pay directly or the Renter will compensate the Lessor for any fines or penalties applied for the use of the car and the Renter will reimburse us with all the administrative costs, in the amounts according to Annex 2. Damage charges list, regarding information on the lease, responses for the police or other kind of authorities regarding the respective fines or penalties.

DAMAGES. The renter is unconditionally responsible for any damage or theft of the vehicle. Damage is damage to the vehicle that is not normal wear and tear and includes: damage to any part of the body (outside), rims, tires, wheels, headlights, windshield and interior (interior) is paid by the client in accordance with Appendix 2. List of damages.

In case the Car or the goods in the Car are stolen or illegally taken, or the car is implicated in an accident, you will follow the clauses provided in the this Terms and conditions and you will take all measures necessary to protect Lessor interests, and particularly the Renter undertake to:

a) to provide to Lessor immediately or in maximum 24 hours complete details on the situation occurred regarding all damages caused or produced to the Car or if the Car does not run properly. In case you are injured and cannot inform us about the accident in the term mentioned above, you will do so as soon as possible. In case the Car was already damaged or the Renter acknowledge it is damaged and by using it the Renter could cause additional damages, the Renter undertake to stop using the Car, otherwise the Renter bear the entire repair costs.

b) Renter has to hand over to the Lessor a copy of the police record.

c) The Renter or the driver fill in and deliver the Accident Report to be handed over to the Lessor in 24 hours from the accident; In this report drive have to include the circumstances, date, time and place of the accident, name and addresses of the witnesses, name and address of the owner of the other car involved in the accident, including the identification number of this car, the name of the insurance Renter, and the number of the insurance policy for this car.

d) to cooperate with the authorities in order to establish the correct circumstances of the accident, leaving the authorities the decision for establishing the guilty party in accident;

f) to inform the police regarding any theft or illegal dispossession;

f) to send us immediately all letters from third parties, summons or other documents related to legal proceedings that you receive in relation to the car;

In case the Renter does not follow any conditions of point 1, all inssurances and protections packages are not valid and the Renter takes full responsibility for the car and for third parties and will pay for all damages and thefts and losses on car return.

If the Renter is disagrees with the decision of the police, when challenging the Police Record from the police, he will pay all damages to the Lessor, p2. And for the period of the dispute, because the Lessor will not be able to use the Car, the Contract will be substantially extended and the Renter will pay the Lessor the rental payment under the Rental Agreement until the date of the final decision on the part of the Liability Guarantor.

In the event that the Renter presents the final decision by which he disputes the Police Record of unguilty, the Lessor shall return to the Renter part of the amount paid by the Renter for damages incurred within the limits of the franchise and the damages in Appendix 2 and 3, and the Renter's obligation to pay the rent for the period of the dispute will remain valid.

In the event of a fault-accident, Lessor will not refund unused days of rental.

ACCIDENT

In case of any road accident or theft as well as in case of any thread of the theft, the Customer will immediately inform the Lessor by the phone +37368008088 and the Police Office (112) the follow their instructions. A police record is mandatory for all assurances and protections. In case that the Renter/driver does not ensure police presence or a police record, the full amount for the damage and/or theft will be charged to the driver irrespective of the kind of the purchased protection. At return the Customer must present to the Lessor copies of all documents the Renter/Driver countersigned. If the Customer has an accident requires assistance from the Lessor, the renter will be charged a 200 EUR Administration Fee.

LOSSES. Customer is obliged to return with the car with the documents, the key and all other received goods received with the car. In case the documents, keys, or other goods are not returned for any reason, the Customer will pay fine as compensation: 200EUR for loss of the car’s registration certificate, 300EUR for the loss of the keys which not includes the keys cost, 200EUR for damage or loss of GPS navigator or Wi-Fi rooter -200EUR; 100EUR for loss car’s license plate, 50EUR- for loss of insurance policy, technical report, legislative kit, tire repair kit.

ADMINISTRATION FEE FOR TRAFIC FINES

The During the rental, the Renter will bear all costs for:

- all traffic fines for illegal parking of the Car or speeding.

-all fines for contravention actions committed with the Car, according to the legislation during the lease period.

The amount of the Administrative Charge for the Processing of Fines

If the Renter has a traffic/parking fine during the rental period, the Lessor reserves the right to charge the Renter’s credit card or by any other means a fee that corresponds a fine paid by the Renter for traffic violation.

The Renter will be charged an Administration Fee according to the Annex 4, together with the amount of fine if it is stated in the police protocol.

ACCIDENT HANDLING FEE

In case of incident, accident, theft or attempted theft with damages to the car, the renter must obtain the necessary legal documents from the police and present them to Lessor together with the returned car. A charge for accident handling will apply for each independent Damage Record to cover the administration expenses:
- 25,00 EUR - if the renter is not guilty,
- 50,00 EUR - if the renter is guilty,
- 200.00 EUR - if the renter fails to present police record and all the protections will be voided. Alternatively, the renter can request Renter to collect damage records for an additional charge of 50.00 EUR per day. Out of hours charge of 20,00 EUR and additional charge of 1.00 EUR per kilometer outside limits of city will apply.

The renter will be charged an Administration Fee till 200.00 EUR additionally to the resulting damage. The Damage Handling Fee (Administration Fee) depends on Renter's assistance in case of damage. (Annex 2. Damage charges list).

Should the Renter require official damage and repair documentation an administration fee will apply. 75.00 EUR per request (Administration Fee For Damage Documentation).

CAR SPECIAL CLEANING

All Lessor cars are non-smoking cars. In case of evidence of smoking (dust, cigarette stub, smell caused by smoking, cigarette’s burns) the renter will be charged with a penalty of 100 eur. Additional fees for damaged parts, will apply.

Additionally, in case the car require a special cleaning procedure (i.e. smell removal caused by smoking, animal pollution, spill of liquids, sand, mud, vomit or ink, or ionization of allergens after pet transportation etc.) after returning, additional charge of 100.00 EUR will apply

USAGE FEE

If the car is not returned by the renter on the agreed date, and if a period of 24 hours elapsed without there being any news regarding the delay, additional fee will apply prices established in the Pricelist Additional Charges (Annex 2).

SEIZURE

The Renter is obliged to indemnify the Lessor against any costs arising from the seizure, unless otherwise agreed, in writing In the event of seizure for administrative reasons, civil or criminal law, the enter remains obliged to fulfil the obligations of the Rental Agreement, including payment of the rental price, until the moment the car is returned to the Lessor, free from restrictions, interdictions unless the seizure is in connection of the Lessor.

In case the Car is lost or is brought to a state where its’ repair is no longer justified from an economic point of view, the Renter will bear all administrative and legal expenses related to the settlement of all claims or petitions formulated by us or against us in relation to the Car and the Renter will cover all damages caused to us that are not covered by the insurance policies Renter have concluded with the insurance Renter for the Car.

IMMOBILIZATION FEE

The Renter will be liable for all the damages the Renter caused us by losing the rental income for the duration the Car is repaired, in case of damage, regardless of the cause of the damage, except for the case where the damage was caused by Renter fault. The amount of the unachieved income due to losing the lease will be calculated according to the normal lease price for the repair duration or until an agreement is reached and the payment is received.

PAYMENTS

All amounts stated in RA in EUR are payable in Moldavian Lei (MDL) at the rate specified in RA, which is based on commercial exchange rate of the Lessor’s Bank in force on the payment date. Exceptions: then the renter paid in advance the Prepaid rate for rental and the prepaid amount will be collected by Lessor form the broker, agency or partner. In case the payment of any amount is made with American Express credit card, the customer will pay additional 5%.

PENALTY

In case the Customer fails to pay the invoice/ based on the RA (services, extras, damages) in 1-day term, the Customer will be liable to pay the Lessor a fine as 0.5%/day from the due amount.

COMMUNICATION

The Renter is responsible for providing the residential address and genuine electronics in the contract in order to receive invoices, claims, etc. from the landlord, in accordance with the agreement and applicable law.

The renter gives consent to the lessor to send invoices to the recipient previously specified, in electronic form in accordance with the current legislation, to the registered email address. The renter is responsible for ensuring that the electronic invoices will be received correctly, or if agreed so, be collected in electronic format.

RESOLUTION

The Lessor will ask for the resolution of the agreement if :

a) Renter does not use the car property or uses violations of present T&C (Exclusions);

b) does not pay the rent for maximum 2 days after the expiry of term of payment;

c) renter did not supplied with accurate and true information for Agreement.

In these cases, the Lessor will stop the rental before the agreed date / time of return by sending a written notice, by e-mail, telephone or in person. The Renter is obliged to return the car to the place mentioned in the notice within 4 hours of receiving the notice. Otherwise, the Lessor will consider that the Renter is in possession of the car without the approval of the Lessor and will address the police to recover the car by legal means, including by declaring it as stolen. The lessor will also withdraw the car by using his own means, acting within the limits of the legal provisions in force.

APPLICABLE LEGISLATION

If some situation arising from Rental Agreement is not stipulated, the provision of the law of Republic of Moldova will apply.

Every dispute with regard to the Rental Agreement falls under the sole jurisdiction of the court of Chisinau, Republic of Moldova.

Any amendment to the Terms and Conditions May be effected in writing or through E-mail messages (including those without a qualified electronic signature). For the amendments effected by E-mail messages to be effective they acceptance by the other party expressed in any form shall be necessary.

In the event of any language discrepancy of the translations of the Terms and Conditions, the Romanian version shall prevail
